Client in his mid-50s injured his rotator cuff after falling on ice. The injury required two surgeries, and the case was settled with the Employer. Although the client suffered from pain due to a previous low back surgery, that condition was worsened by a fall after initial work injury. The Pitts Law Firm successfully defended against the Fund’s post-accident worsening allegation and conducted a final hearing. After a successful appeal of that award to the Labor and Industrial Relations Commission, the client was awarded permanent total disability benefits for life. Client received $140,000 in past-due payments and is scheduled to receive an additional $625,000 over the next 20+ years.
