PERMANENT TOTAL DISABILITY

Not every injured worker can return to the workforce.

Unfortunately, some injuries are so debilitating that you are unable to rejoin your employer, and no other employer is willing to accommodate your medical conditions, permanent disabilities, and work restrictions. If this is your situation, think carefully about who you hire for legal representation. Any attorney can reach a fast and nominal settlement for your injuries. To maximize the value of your catastrophic injury and provide for your future, you need an attorney that specializes in workers with permanent and total disabling injuries. At the Pitts Law Firm, Jon Pitts provides aggressive and knowledgeable legal representation for these seriously injured clients. We have carefully cultivated relationships with experts to ensure your restrictions are accurately assessed….

In addition, we help our permanently totally disabled clients obtain Social Security Disability benefits while their workers compensation case is pending. And we structure all settlements to ensure you receive the maximum combined benefits between your workers’ compensation settlement and monthly Social Security Disability payments.

Permanent Total Disability Payments

If you are found to be permanently totally disabled, you are entitled to two-thirds (66.6%) of your wages prior to your work injury, up to the maximum allowed by the state of Missouri. Benefits can be paid either weekly or in a lump sum settlement.

If, prior to your work injury, you had medical conditions or prior surgeries that caused significant problems, your employer may not owe permanent total disability benefits. Instead, the Missouri Second Injury Fund may have liability for those benefits. Our attorneys at The Pitts Law Firm will strongly advocate for you to receive the resources necessary to provide for your life and family.
